1. Acceptance of these terms

By creating an account or using Botoochat, you agree to be bound by these Terms of Service. If you do not agree with these terms, you may not use the service.

Botoochat is operated by a registered business in Algeria.

2. What Botoochat provides

Botoochat is an AI-powered customer service automation tool that:

• Connects to your Facebook Messenger and Instagram Direct accounts via the official Meta APIs
• Uses AI to respond to customer messages on your behalf in Darja, French, Arabic, or English
• Captures and confirms cash-on-delivery (COD) orders from customer conversations
• Sends you WhatsApp notifications when orders are confirmed
• Provides a dashboard for managing your products, delivery pricing, and AI assistant configuration

3. Account eligibility

To use Botoochat you must:

• Be at least 18 years old
• Own or have authorization to manage the Facebook and Instagram business pages you connect to Botoochat
• Operate a legitimate business or commercial activity
• Provide accurate registration information
• Maintain the security of your account credentials

4. Your responsibilities

Compliance with platform policies

You agree to comply with all applicable policies of the platforms Botoochat connects to, including:

• Meta's Community Standards and Commerce Policies
• Facebook's Pages Terms and Messenger Platform Policy
• Instagram's Community Guidelines
• WhatsApp Business Policy

Lawful use

You agree NOT to use Botoochat for:

• Sending spam, unsolicited bulk messages, or harassment
• Selling prohibited or illegal goods or services
• Deceiving customers or making false product claims
• Collecting customer data for purposes outside the scope of your business operations
• Activities that violate Algerian law or the laws of your customers' jurisdictions

Accuracy of business information

You are responsible for ensuring the accuracy of the product catalog, pricing, delivery rates, and AI assistant instructions you configure in Botoochat. We are not liable for losses resulting from incorrect information you provide.

5. Subscription plans and billing

Subscription plan

Botoochat offers a single subscription plan:

• Botoochat Complete: 7,200 DZD (≈ $28) per month — unlimited conversations for one Facebook page and one Instagram account

The plan includes WhatsApp order notifications, fake order detection, delivery pricing for all 69 wilayas, and the multilingual AI assistant (Darja, French, and Arabic). There are no per-conversation overage charges.

Free trial

All new accounts receive a free trial of 50 conversations. No credit card is required to start the trial.

Payment terms

Subscription fees are charged in advance on a monthly or annual basis depending on your selected billing cycle. Payment methods and billing arrangements are agreed individually with each customer at signup.

Refunds

Subscription fees are non-refundable except where required by law. If you cancel mid-month, your subscription remains active until the end of the current billing period and is not pro-rated.

6. Cancellation and termination

Cancellation by you

You may cancel your subscription at any time by emailing support@botoochat.online or through your dashboard. Cancellations take effect at the end of your current billing period.

Termination by us

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Use the service in a way that violates Meta's policies
• Fail to pay subscription fees after 14 days notice
• Engage in activities that harm other users, our service, or our reputation

Effect of termination

Upon termination, your access to the dashboard ends, your connected pages are disconnected from our service, and your data is retained for 30 days before permanent deletion (as described in our Privacy Policy).

7. Service availability

We strive for high availability but do not guarantee 100% uptime. The service may be unavailable due to scheduled maintenance, technical issues, third-party platform outages (such as Meta or WhatsApp), or events outside our control.

We are not liable for losses resulting from temporary service interruptions.

8. AI-generated content disclaimer

Botoochat uses AI to generate responses to customer messages. While we work to ensure accuracy:

• AI responses are based on the product information and instructions YOU provide
• The AI may occasionally generate incorrect, incomplete, or inappropriate responses
• You are responsible for reviewing AI behavior and adjusting configuration as needed
• We are not liable for losses arising from AI-generated responses

9. Intellectual property

The Botoochat name, logo, software, and all related materials are the intellectual property of Botoochat's proprietor. You receive a limited, non-exclusive, non-transferable license to use the service for your business operations.

You retain ownership of all content you upload (products, descriptions, images, AI instructions). You grant us a license to use this content only for the purpose of providing the service to you.

10. Limitation of liability

To the maximum extent permitted by law:

• Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim
• We are not liable for indirect, incidental, consequential, or punitive damages
• We are not liable for lost profits, lost sales, or business interruption
• We are not liable for the actions or omissions of third-party platforms (such as Meta or WhatsApp)

11. Changes to these terms

We may update these Terms of Service from time to time. For material changes, we will notify active subscribers by email at least 30 days before the changes take effect. Continued use of Botoochat after the effective date constitutes acceptance of the updated terms.

12. Governing law

These Terms of Service are governed by the laws of the People's Democratic Republic of Algeria. Any disputes shall be resolved by the competent courts of Algeria.
